The actions taken by Robert Manning, the CEO of Global Shippers, demonstrate a clear violation of the global law and ethics codes of conduct. In this case, Robert is seen declining the prime minister’s request to deposit a sum of $100,000 into his account if at all, he was to win the tender. While Robert declined this request, he offers to give the prime minister gifts that are meant to entice him into agreeing to the deal. This means that Robert decision to decline the prime minister’s request was not genuine, but a tactic meant to conceal his actions since such a move would have been easy to trace. Instead, he thinks that by offering the prime minister expensive gifts that would work to conceal any form of bribery. Robert’s actions are, therefore, a demonstration of the fact that despite him knowing that bribery is illegal and the consequences that come with it, he went ahead to commit corruption. In this case, Robert was also in contravention of the UK Bribery Act, which prohibits against the fuse of bribes to facilitate any business process either at the individual or corporate level with any government.
At the level of a CEO, Robert ought to have been aware of the Foreign Corrupt Practices Act (FCPA) which was established to prevent organizations and individuals from engaging with foreign governments directly to obtain or retain government business without following the right channels (Goodwin, 2019). Though Robert appeared to uphold this international legal requirement by declining the prime ministers request to deposit $100, 000 in his account, he decided to use unethical means to make up for this decision. Offering the prime minister expensive gifts and trips where they would have a private conversation is unethical and an indirect violation of the FCPA because it would give Robert’s organization an unfair advantage over other competitors of the same tender.
