Due process rights are a critical aspect of the criminal justice system and are designed to protect individuals from abuses of power by the government. These rights are guaranteed by the Fourth, Fifth, and Fourteenth Amendments of the United States Constitution.
During a suspect’s initial contact with police, several due process rights come into play, including the stop, frisk, search, seizure, and arrest.
The stop: The Fourth Amendment protects individuals from unreasonable searches and seizures. During a stop, police must have reasonable suspicion that a crime has been or is about to be committed in order to detain an individual. Reasonable suspicion must be based on specific and articulable facts, rather than a hunch or general suspicion.
The frisk: If, during a stop, police have reasonable suspicion that an individual is armed and dangerous, they may conduct a frisk, or pat-down, of the individual’s outer clothing to check for weapons. The frisk must be limited in scope and cannot be used as a pretext for a search for evidence of a crime.
The search: The Fourth Amendment also protects individuals from unreasonable searches. In order to search an individual or their property, police must have probable cause to believe that evidence of a crime is present. Probable cause must be based on specific and articulable facts, rather than a hunch or general suspicion.
The seizure: The Fourth Amendment protects individuals from the seizure of their property unless there is probable cause to believe that it is evidence of a crime.
The arrest: The Fifth Amendment protects individuals from being arrested without probable cause. Probable cause must be based on specific and articulable facts, rather than a hunch or general suspicion.
It is important for criminal justice professionals to ensure that these due process rights are upheld in order to protect the rights of suspects and maintain the integrity of the criminal justice system. This can be achieved by following proper procedures and being transparent about the reasons for a stop, frisk, search, seizure, or arrest.
