Criminal Profiling
The United States and other states have practiced criminal profiling in their criminal justice and as a law enforcement tool for quite some time now. Criminal profiling is an investigative analysis carried out when no observable evidence left by the offender at the crime scene. Criminal profiling is a useful tool, although receiving critics and challenges from mental health professions. The paper will talk about criminal profiling, inclusive of strengths and weaknesses.
Criminal profiling began in 1960 by Teten and Mullay, a psychologist in abnormal behavior which took place when it was challenging to identify illegal behavior. The first profile took place in 1970 during the case of a stabbed woman in her home. Teten, through the documents acquired, concluded that an adolescent boy had committed the crime, and during the profiling, the boy confessed out of guilt. Criminal profiling was based on behavior that reflects a person’s personality.
Profiling generally involves searching for information about a case, for instance, gender, height, and so on. The features enable the investigator to identify the suspect.Information used include the location and time of the crime, condition of the crime scene, nature of the offense as well as information collected after communicating with the suspect.
Criminal profiling is an investigative tool that involves searches and seizures during the process. Searches and seizure are conducted systematically or lawfully according to the fourth amendment, which protects individuals from searches in private considered places, for instance, in handbags. During a search, a search warrant is relevant, which consist of an authorized written order is. A law enforcer or a profiler without a search warrant is not allowed to search according to the fourth amendment.
Probable cause to conduct any search, seize of property, and arrest is necessary by any investigative law enforcer. The exclusionary rule is used to deter police misconduct, where the state allows the court to eliminate evidence and enables defendants to challenge the admissibility of evidence. The rule “fruit of the poisonous tree” is related to exclusionary rule where the court dismissed unconstitutional searches and illegal searches. Criminal profilers should have the knowledge and skills to go about the laws according to the fourth amendment while carrying out their activities.Crimes suitable for profiling include; violent crimes, long or a series of crimes, crimes involving psychopathy as well as attacks.
Criminal profiling consists of various strengths, including assisting law enforcers in apprehending suspects quickly by realizing their behaviors and physical characteristics. Criminal profiling takes less time compared to other investigative tools, therefore, saving the lives of the offender attacking more innocent people. Criminal profiling has a significant focus on reliability, especially in classifying types of crimes such as organized and disorganized crimes. Criminal profiling is vital in protecting targeted victims; for instance, notifying a group of people to relocate or warn people on walking at night. Profiling is an essential resource, especially in creating a criminal profile making it easier to trace and capture the offender.
Criminal profiling faces challenges, as well as consists of weaknesses such as criminal profiling, based on education assumptions, especially the psychology of behavioral characteristics in determining an offender’s personality. Law enforcers look beyond the assumed as well as detailed information missing out on arresting the suspect outside the profile. Criminal profiling methods are limited; therefore, any pattern out of the scientific approach and techniques would not fit. Criminal profiling is based on fixed facts; for instance, an offender steals due to a lack of money, which might be far from reality. Some people commit crimes out of peer pressure, as well as a fun practice. Criminal profiling only provides the type of suspect through the profile but no specific person in the profile. Most courts have dismissed profiling testimonies due to a lack of scientific evidence.
Criminal profiling is useful and dependable in most significant cases, regardless of the weaknesses. The society should allow criminal profiling in identifying suspects as well as law enforcers.Thou law enforcers have inadequate knowledge and skills compared to train profilers; therefore, law enforcers are not allowed to carry out criminal profiling. For the society to fully accept profiling, the profilers should calmly conduct the process concerning human rights of freedom of speech as well as the use of search warrants according to the fourteenth amendment.
The profiler activity is defined as art from the perception of crime.Criminal profiling as science started in 1970 through systematic investigation and viewing criminal profiling as an investigative tool. Criminal profiling uses techniques and skills in analyzing crimes through intense training and experience in the field of inquiry. The criminal profiler uses forensic-science knowledge and psychology, making the practice more of a science than an art.
The class I have learned the most includes the topic of criminal profiling, especially in realizing criminal profiling is more of a science than an art. I enjoyed the history of criminal profiling, primarily through cases you used in explaining how profiling came to existence. Every teaching style was effective and resulted in a clear understanding of criminal profiling.
