The bill of rights is a collection of rights regarding the government which guarantees liberties and civil rights like the freedom of press, religion, and speech among others. in other words, it is the first ten amendments of the constitution (Rossum, 2018). In 2017, Bangladesh had three hundred and thirty-five violations of the right to freedom of expression. Since 2013, that was the highest number of violations to be recorded. Seventy percent of that number constituted of journalists working at the grassroots level. There has been crimination of expression and misuse of law in restricting expression over the last five years which has been rising steadily.
In silencing communicators and journalists there has been less the application of physical violence over the years. The shift in the nature of harassment and violations is a significant one meaning that cases of legal harassment of communicators have been rising from thirty-three in 2013 to one hundred and sixty-nine in 2017 while the use of assault and physical force as a tactic of silencing has been dropping from one hundred and seventy-three in 2013 to one hundred and thirteen in 2017 (Bangladesh: Violations of the right to freedom of expression in 2017, 2018). The justice system has been having the pattern of apathy and impunity despite the violations against the right to freedom of expression.
Still, in 2017, cases of forty-two journalists had not taken any legal steps. Of the one hundred and twenty-six cases that had taken the legal step, only six of the cases preliminary investigations had been completed. Twenty cases of killing of bloggers and journalists had been conducted of course with delays. The existing legislation like section 57 of the ICT ACT2006 still imposes impermissibly broad limits on freedom of expression both offline and online. The new legislative proposals like the proposed Digital Security Act 2016 threaten more restrictions that contradict international standards.
