California Consumer Privacy Act
This is a bill that was passed in California to help protect the people’s privacy and the consumer of California. Its aims at informing the residents what information is collected about them, know if their information is being shared and to whom. Being able to access their personal data, decline the sale of their personal data and obtain equal rights in services and pricing in goods (Garrie Esq, 2019).
The law governs over businesses conducted within California, it also applies to the entity that uses personal information and defines the purpose of using it. It applies to the companies that have a gross income of 25million US dollars. Those that have obtained more than 50thousand personal information on the residents and those that have gained up to 50% revenue income from selling personal information of the California residents. The law not only contains consumer IP information but also information that can be traced to a given household. It also does not define any legislative grounds for processing it. Although it does not need one’s consent in processing it, it enhances privacy by allowing one to know which information is collected and grants ones access to a copy of their information. It also provides an obligation like website numbers to send information requests. Even though the selling of personal information is not prohibited in California, businesses are required to provide an option that gives the consumer the right to allow their information to be shared to a third party (Shneyder, 2019).
Non-compliance to this act lies within the California attorney general’s jurisdiction. If a company intentionally violates the law they can pay up to 7500 dollars for the damage. Unintentional may amount to 2500dollars. in the case of data breaching one has right to take private statutory action and may obtain recovery damages for up to 100 to 750 dollars or the amount the court deems fit.
