In my opinion, there should be US and international laws that restrict persons from selling their body parts for personal gain. This will serve to prevent people especially the poor from selling important part of their bodies due to desperation. The current lack or inadequacy thereof of international laws that restrict the selling of human body parts has led to the exploitation of the poor particularly in developing countries. According to Ng (2019), poor people in these countries are willing and desperate to sell their organs without comprehending the consequences of their actions; for them, it is just a matter of survival in a difficult world. This has led to the growth of the black market that sells human organs. As such, the poor have been exploited and paid peanuts for their organs, and in some cases, have not received any payment at all. Moreover, the sale of organs in the black market means that if things do not go well, the seller lacks does not have any legal option and there is a less likelihood of him/her getting appropriate medical care prior to, during and after surgery.
There are people who believe that people should be allowed to sell their body parts as they will, and therefore, should not be restricted from doing so by laws. Flescher (2018) asserts that the demand for body organs is ever growing, but supply is not catching up any time soon. For this reason, the sale of human organs appears to be a solution to this problem (Flescher, 2018). People searching for a portion of a liver, a kidney, etc., could pay a willing seller for his/her organ. For these proponents, this is justification to allow human organs to be sold.
